A CONTESTED DIVORCE IN GUAM

A contested divorce is where the spouses cannot agree on one or more key issues and must go to court to ask a judge to decide. The typical hot button issues that spouses often fight about include:

  • child custody
  • child support
  • property division
  • dividing the debts
  • alimony or spousal support
  • Sometimes, one party just refuses to agree to divorce even though there is nothing to fight about.

A contested divorce begins when one spouse files a DIVORCE COMPLAINT, and has it served on the other spouse. To file a complaint for a contested divorce in Guam, you must first be a Guam resident for at least 90 days. (click here for more information on this residency requirement).

In contested divorce we, like other Guam law firms, charge by the hour, based on the time spent by our attorneys and other professionals on the case. The cost of a contested divorce varies a great deal depending on the number of issues the parties are fighting about, the value of the property and debts, and the willingness of the parties to make compromises.

Usually, a client in a contested divorce will be expected to provide a down payment (often called a "retainer") to cover some of the expected charges, and then will receive a monthly bill based on the time and expenses spent by the professionals. 

To start, we will ask you for information about your marriage and the issues you cannot agree upon. We will then provide you with a proposal so you will know the estimated costs before you hire us. We will also give you our opinion on how the case is likely to come out.  WE DO NOT CHARGE FOR PREPARING THE PROPOSAL AND IT IS PART OF OUR FREE INITIAL CONSULTATION, Our proposal will include:

  • The amount of the down payment (usually between $2000 and $5000)
  • The hourly rate charged for attorney and professional time
  • Estimated filing fees and other expenses
  • Estimated total cost
  • Estimated time it will take to complete the divorce
  • Our assessment of the case and how we think it is likely to come out.
